Graffiti Paint Protection

Who owns the rights to graffiti.?
If someone illegally spray paints a wall do they own the copyright to it. Copyright law states “copyright protection attaches to the stated subject matter when an original work of authorship is fixed to any tangible medium of expression.” So the question is something created illegally covered under this? Please cite your information.
Yes, copyright law does not deal with legalities of who owns the medium or the tools used to create works protected by copyright law the moment they are "fixed in tangible form". If you write a book using your sister's computer, even if she does your typing, it's still YOUR book.
However, the graffiti "artist" has no claim to possession of the copy and it can be painted over or torn down by the owner of the surface upon which it was painted. The artist does, on the other hand, have statutory "moral rights" to claim the authorship and to object to unauthorized modifications of the work. However, because it may have been a crime (a type of vandalism) to create it in the first place, not a lot of them come forward to file copyright complaints.

anti graffiti paint?
is it a good idea to paint the rubber sole?
i bought some nike blazers the other day and there orange and black with a white rubber sole and i just happend to have a orange paint marker so i started putting a lil graffiti on the white sole i had to go out before i finished and i looked at my blazers when i was on the way home and some of the paint smudged off and "a lil bit" got on some of the black material....was painting the rubber a big FAIL? or should i just stick to original plan and finish the design and spray paint protection coating on when i get the chance?
Paint is not good idea on bottom of shoes or footwear in general, soles are design for you keep traction on ground, paints and coatings could create slippery surface, in rain, or tacky in heat, you could accidentally walk into some friends house and leave colored steps on rug and carpet, not safe,
if you do not like white color, you could place new replacement sole on shoe with contact cement or shoe glues, but not really good idea for new shoes,
